Iurie Mărgineanu: Puterea judecătorească a fost uzurpată în Republica Moldova, de către actuala Guvernare.

De doi ani de zile, în țară avem parte de un Consiliu Superior al Magistraturii (CSM) nelucrativ, membrilor cărora li s-a spus, de către cei aflați la Guvernare, să lucreze în asemenea mod, iar pentru asta vor primi susținere politică necesară. Declarația aparține juristului și conferențiarului universitar, Iurie Mărgineanu. În cadrul emisiunii PULS de la Orizont TV, Mărgineanu a declarat, că puterea judecătorească a fost uzurpată în Republica Moldova, statul care ar continua să fie capturat.
IURIE MĂRGINEANU, conferențiar universitar: „S-a început de la CSM. Doi ani de zile un CSM nelucrativ, cu mandatele expirate și li s-a spus să lucreze că așa va fi și noi o să vă susținem politic. Politic au fost susținuți pe toate căile. Amintim că, 21 candidați la funcția de membru al CSM și al CSP, care nu au trecut evaluarea Comisiei Pre-Vetting, vor fi reevaluați, conform deciziilor completului de judecată special al CSJ. Premierul a calificat decizia drept o rezistență a sistemului la reforma justiției, inițiată de guvernare, și a dat asigurări că toți cei care au luat decizia vor fi trași la răspundere.
Iar președintele Comisiei juridice, numiri și imunități , Olesea Stamate a declarat că deciziile recente ale CSJ, prin care încearcă să anuleze toate hotărârile comisiei Pre-vetting, demonstrează clar că unii judecători nu vor vetting. În reacție, Curtea Supremă de Justiției a menționat că au existat mai multe încălcări care au dus la anularea deciziei Comisiei de Pre-Vetting.

Among these are the erroneous interpretation of the rules of material law that regulate the evaluation, especially of the undefined legal concepts, which form the legal basis for issuing the decisions of the Evaluation Commission; wrong establishment of the facts and their biased assessment; unequal treatment for similar acts; interference in the rights of judges, prosecutors, and other candidates contrary to the principle of proportionality. The Supreme Court of Justice recommended politicians, government, interest groups, the media and anyone to refrain from humiliating labeling, public lynching and televised justice.
