DM network Limited Terms of Services

This legally binding agreement (hereinafter referred to as the “Terms”) governs your (hereinafter referred to as the “User”) use of the applications located in the Internet at angel-gamez.com and any applications offered by other DM network Limited Services (hereinafter referred to as “DM network”) and accessed through third party web sites (collectively referred to as the “Services”). Any use of the Services or access to them confirms the User’s agreement to be bound by these Terms. DM network has the right to modify these Terms in any way upon their consent without prior notification of the other party. Modified Terms shall come in force upon their publication at the front page of angel-gamez.com . Access to the Services after modified Terms have been published at angel-gamez.com shall be recognized as the User’s consent with the new version of the Terms.
1) Accessing the Services
1.1 Any application available directly at angel-gamez.com or through third party web sites shall be considered part of the Services in case these Terms are published together with it at the front page of the application or link to these Terms is positioned in the lower part of the application screen. 1.2.By accepting these Terms the User is granted a non-exclusive, non-transferable, revocable limited license to use and display the Services for the User’s personal non-commercial use. The User shall not utilize the Services for any other purpose, or to copy or distribute the content of the Services except as stated in these Terms. By accepting these Terms the User also agrees to be bound by any application, forum, or other rules published within the Services.
1.3. DM network reserves the right to discontinue the Services (or support of any application included in the Services) or to change the content of the Services in any way and at any time without notice to the User, without liability.
1.4. DM network reserves the right to terminate the User’s access to the Services without notice in case of User’s single or multiple violation of these Terms.
1.5. The User represents that the User is 13 years old or older. Additionally, if the User is between the ages of 13 and 18, the User represents that the User’s legal guardian has reviewed and agrees to the Terms.
1.6. Paragraph names in these Terms are introduced in order to facilitate reading and shall not be taken in consideration while settling disputes.
2) Ownership of Intellectual Property
2.1. Unless otherwise specified in writing, all materials that are part of the Services are owned, controlled and licensed by DM network and are protected by law from any unauthorized use. The Services are copyrighted under the Russian Federation copyright laws and/or similar laws of other jurisdictions. All logos and game names used in the Services are trademarks of DM network and may not be used without the prior personal written permission of Angel Games. The User agrees not to copy, redistribute, publish or otherwise exploit material from the Services, except as expressly permitted herein, without the prior personal written permission of DM network.
2.2. The User does not acquire any ownership rights by using the Services, downloading material from or uploading material to the Services, or by purchasing any virtual goods.
2.3. Any submissions (hereinafter referred to as the "Feedback") disclosed, submitted, offered or sent in other way to DM network in connection with the use of the Services shall be the exclusive property of Angel Games. The User agrees that DM network may use, sell, exploit and disclose the Feedback in any manner, without restriction and without compensation to the User.
3) In-Game currencies/goods
3.1. The Services include a virtual, in-game currency (“Virtual Currency”) that may be purchased from DM network for “real world” money if the User are a legal adult in the User’s country of residence. The Services may also include virtual, in-game digital items (“Virtual Goods”) that may be purchased from DM network for “real world” money or for Virtual Currency. Regardless of the terminology used, Virtual Currency and Virtual Goods may never be redeemed for “real world” money, goods or other items of monetary value from DM network or any other party. Attempt to sell or an actual sale of any of the aforementioned Virtual Currency or Virtual Goods for “real world” money to any other User is considered a violation of this paragraph and the Terms as the whole and it grants DM network the right to terminate the User’s account in the Services. The User only has a limited, personal, revocable, non-transferable, non-sublicenseable license to use the Virtual Goods or Virtual Currency in the Services. No other rights originate from purchase of Virtual Goods or Virtual Currency from Angel Games. All Virtual Goods and Currencies are forfeited if the User’s account is terminated or suspended for any reason, in DM network’s sole and absolute discretion, or if DM network discontinues providing the Services.
3.2. DM network has the absolute right to manage, regulate, control, modify and/or eliminate such Virtual Currency and/or Virtual Goods as it sees fit in its sole discretion, and DM network shall have no liability to the User or anyone for the exercise of such rights.
4) User Content
4.1.The Services may inspire the User in different ways to chat or participate in blogs, message boards, online forums and other public activities and may provide the User with the opportunity to transmit or broadcast content and materials to DM network and/or to or via the Services any User-made material (collectively referred to as the "User Content"). Any material the User transmits to DM network will be treated as non-confidential and non-proprietary. The User agrees that the User Content they are transferring to the Services is wholly original to the User and it is free of any third-party rights to it.
4.2. The User grants to DM network the unrestricted, unconditional, unlimited, worldwide, irrevocable, perpetual fully-paid and royalty-free right and license to exploit in any manner whatsoever, all or any portion of the User’s User Content to which the User have contributed, for any purpose whatsoever, in any formats. 4.3.DM network has no obligation to accept, display, review, monitor, or maintain any User Content. Angel Games has the right to delete User Content from the Services without notice for any reason at any time. DM network may manage the User Content without notice to the User and without liability.
5) Usage Rules
5.1) As a condition of the User’s access to the Services, the User agrees to comply with these Usage Rules, which are obligatory and may be added in the specific Services usage rules.
5.2.) The User agrees that the User’s conduct on the Services shall be lawful and the User’s User Content will not:
i) include any offensive comments that are connected to race, national origin, gender, sexual preference or physical handicap;
ii) include profanity or any obscene, indecent, pornographic, sexual or otherwise objectionable content or language;
iii) defame, libel, ridicule, mock, disparage, threaten, harass, intimidate or abuse anyone;
iv) promote violence or describe how to perform a violent act
v) violate the contractual, personal, intellectual property or other rights of any party, or promote or constitute illegal activity; or
vi) be in violation of these Terms or the game rules of conduct.
5.3.) The User and the User’s activities on the Services will not:
i) reveal any personal information about another individual, including another person's address, phone number, e-mail address, credit card number or any information that may be used to track, contact or impersonate that individual;
ii) attempt to impersonate any other party;
iii) create user accounts by automated means or under false pretenses or mislead others as to the origins of the User’s communications;
iv) trick, defraud or mislead DM network and other users, especially in any attempt to learn sensitive account information such as passwords;
v) make improper use of DM network’s support Services or submit false reports of abuse or misconduct;
vi) use the Services for promotion of any other product.
vii) perform any act harming the Services. This shall be decided by DM network.
viii) violate these Terms.
ix) disseminate, upload or transmit viruses, worms, Trojan horses, RATs, keyboard loggers, time bombs, spyware, adware, cancelbots or any other malicious or invasive code or program; use any unauthorized script (bots, cheat utilities and other) or other software;
xi) copy, adapt, reverse engineer, decompile, reverse assemble or modify any of the Services’s code;
xv) cover or obscure any notice, banner or advertisement on the Services;
xvi) use tools which anonymize the User’s internet protocol address (e.g. anonymous proxy) to access the Services;
xvii) interfere with or circumvent any security feature of the Services or any feature that restricts or enforces limitations on use of or access to the Services, Collaborative Content or the User Content;
xviii) sell the Services or any part thereof including but not limited to Virtual Goods or Virtual Currency, user accounts and access to them in exchange for real currency or items of monetary value;
xix) engage in cheating or any other activity deemed by DM network to be in conflict with the spirit or intent of the Services.
5.4) DM network does not control or endorse the content, messages or information found in User Content portions of the Services or external sites that may be linked to or from the games or their forums and, therefore, Angel Games specifically disclaims any responsibility with regard thereto.
6) Privacy and Protection of Personal Information.
DM network respects the privacy of visitors to our games. Information collected from the User is subject to the pertinent social network’s policy. By playing the game, the User may be granting the User’s social network permission to share the User’s e-mail address and any other personally identifiable information with Angel Games. Please see DM network’s Privacy Policy at www.angel-gamez.com for more information on the collection and use of the User’s information. The User acknowledge and agree that this Privacy Policy, including, but not limited to, the manner in which DM network collects, uses and discloses the User’s personally identifiable information, is incorporated and made part of these Terms. If User does not agree to each and every part of DM network’s Privacy Policy, then the User should not play the games or submit any personally identifiable information through this game.
7) Disputes with Others
We reserve the right, but have no obligation, to monitor and/or manage disputes between the User and other users of the Services. If the User has a dispute with other users, the User releases DM network and hereby agrees to indemnify DM network from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such dispute.
